These Terms of Service ("Terms") govern your access to and use of https://mariasmarketcanton.com (the "Site"), operated by Maria's Market Place ("we," "us," or "the Store"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Age Requirement

This Site sells alcoholic beverages. You must be at least 21 years old to browse, purchase, or receive an order. By using the Site you represent that you meet this requirement. Age is confirmed at entry to the Site, at checkout, and again at pickup, where a valid government-issued photo ID is required. We may refuse to complete any order where we cannot verify that the purchaser is of legal age, or where the person collecting the order appears intoxicated.

2. Accounts

You may create an account to place an order. You are responsible for keeping your account credentials confidential and for activity under your account. Let us know promptly if you believe your account has been used without your permission.

3. Products, Pricing, and Availability

  • Product descriptions, images, and availability may change without notice.
  • Prices are in U.S. dollars and do not include sales tax, which is calculated at checkout.
  • Spirits sold on this Site comply with the minimum retail shelf pricing set by the Michigan Liquor Control Commission ("MLCC") under MCL 436.1229. We do not sell any spirit below its legally required minimum shelf price.
  • We may limit quantities, refuse any order, and correct pricing or listing errors, including after an order is placed. If we cancel an order because of an error, you will be refunded in full.

4. Orders, Payment, and Cancellation

  • Placing an order is an offer to purchase, which we may accept or decline. An order is not final until we confirm it.
  • Payment is processed by our third-party payment processor at the time of order. We do not store your full payment card details.
  • We may cancel or refuse any order, including for suspected fraud, inability to verify age, or unavailability of product.

5. Pickup

  • Orders placed on this Site are for in-store pickup at 115 N Haggerty Rd, Canton, MI 48187, during the pickup hours shown at checkout.
  • A valid photo ID showing you are 21 or older is required at pickup for any order containing alcohol. We will not release an alcohol order to anyone who cannot produce acceptable ID, or who appears intoxicated.
  • We do not use third-party delivery services to fulfill orders placed directly on this Site. Where we link to our listing on a third-party delivery platform, that is a separate service governed by that platform's own terms — not these Terms.

6. Returns and Cancellations

Because of state alcohol-control restrictions on the resale of returned alcohol, alcohol orders are not eligible for return once released to you at pickup, except where the product is defective or is not what you ordered. An order may be cancelled and refunded before it is fulfilled — contact us using the details below. This section does not limit any right you have under applicable law that cannot be waived.

7. Prohibited Conduct

You agree not to: use the Site if you are under 21; provide false age or identity information; purchase on behalf of, or for resale to, a person under 21; use the Site for any unlawful purpose; or attempt to circumvent any age-verification or quantity-limit feature of the Site.

8. Intellectual Property

The Site, including its design, text, graphics, and underlying software, is owned by or licensed to us and protected by intellectual property law. You may not copy, reproduce, or create derivative works from the Site except as needed for your own personal, non-commercial use of it to place an order.

9. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MARIA'S MARKET PLACE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. Nothing here limits liability where that is prohibited by law.

11. Indemnification

You agree to indemnify and hold harmless Maria's Market Place and its owners, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your provision of false age or identity information, or your violation of any applicable law in connection with your use of the Site.

12. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Wayne County, Michigan.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after a change means you accept the revised Terms.
